Spouses (or registered partners as well as persons who are engaged or have promised to enter into a registered partnership) may also conclude an inheritance contract (§§ 602, 1249 ff ABGB). This is a bilateral contract and requires the form of a notarial deed. The freedom to make a will remains partially intact insofar as the deceased must be able to dispose of at least a pure quarter of the future estate. Whether effects from the inheritance contract are preserved even after the dissolution of the marriage depends on its formulation and the award of fault in the divorce.
